Liability Limitations

1. Disclaimer of Warranties​

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Coroid s.r.o. makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Statutory rights of consumers under applicable law (including Slovak Civil Code §502 and §623, and EU Directives 2019/770 and 2019/771) are not affected.

2. Limitation of Liability​

To the maximum extent permitted by applicable law, in no event shall Coroid s.r.o., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total aggregate liability for any claims arising out of or relating to these terms or the Service shall not exceed the greater of (a) the fees paid by you for the Service in the three (3) months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

Carve-outs: The above limitations do not apply to liability for (i) gross negligence or willful misconduct; (ii) fraud or fraudulent misrepresentation; (iii) death or personal injury caused by negligence; (iv) breach of confidentiality obligations; or (v) any other liability that cannot be excluded or limited under applicable law.

3. High Risk Activities​

The Service is not designed or intended for use in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, weapons systems, or life support machines, in which the failure of the Service could lead directly to death, personal injury, or severe physical or environmental damage.
